Notice for Law Enforcement Agencies Conducting
Tobacco Compliance Sting Operations:

 

Recently there have been numerous news reports regarding the recent arrest by Texas Rangers of a Texas Alcoholic Beverage Commission (TABC) Agent who was charged with Sexual Misconduct and Official Oppression resulting from his alleged illegal activities occurring during a TABC sanctioned alcohol sting.  The Comptroller's Office and Texas STEP want to reiterate the sting operation protocols taught in the grant training program and the proper procedure when performing compliance inspections of tobacco retailers using minors decoys.

It is always important to have two officers accompany a minor on a sting operation.  Under rare circumstances, where staffing makes this impossible, there should be two minors accompany an officer during compliance inspections of tobacco retailers.  This protocol should be used throughout any operation using minors, including through the end of operations with the safe delivery of the minor back to the custody of the parents or guardians.  It is important that each agency review its tobacco sting protocols to ensure these procedures are being followed.   The safety of the minors assisting us in these operations cannot be emphasized enough.
